Buying a Berala home by private sale: how do you get finance in place before exchange?

Have pre-approval in place before you offer, and ask your solicitor for a cooling-off period or a finance clause in the contract.

In NSW a private sale usually carries a five business day cooling-off period, which gives time for the valuation and formal approval, at a small cost if you withdraw.

Private sales and the cooling-off period in Berala

In New South Wales, a residential property bought by private treaty usually comes with a five business day cooling-off period after exchange. During that time you can withdraw, generally forfeiting a small amount set at a quarter of one per cent of the price. Auctions have no cooling-off period.

The cooling-off period is short, so it works best as time to finalise things already underway rather than to start them. Having pre-approval in place, and ideally the lender’s valuation ordered promptly, means you can confirm finance within those days.

The standard contract does not include a finance clause, so if you need one, it has to be negotiated. Questions to ask before you offer

The station shops, the railway and Berala housing

Berala lies about sixteen kilometres west of the city in Cumberland Council, and shares postcode 2141 with Lidcombe.

It connects the inner west, south-west and western parts of Sydney, and a small group of shops sits beside the railway station, including a supermarket, a newsagent and a bakery.

The name comes from Bareela, an Aboriginal word for a musk duck. When the railway line was extended from Lidcombe to Regents Park, the names Torrington, Sidmouth and Bareela were considered for the new station, which opened in 1912.

The public school followed in 1924 and the post office in 1927. Today separate houses make up about six in ten Berala homes.

Example scenario (illustrative, not a real client): a first home buyer finds a Berala house for sale by private treaty.

With pre-approval already in place, they make an offer, exchange with the usual five business day cooling-off period, and have the lender’s valuation ordered the same day so formal approval can be confirmed before the period ends.

Pre-approval before you offer

Pre-approval is a lender’s conditional indication of how much it will lend you, based on your income, expenses and credit. It does not guarantee the loan, because the lender still needs to value the property and confirm your details.

It gives you a realistic budget for negotiating and means the formal approval can move quickly once you exchange. How pre-approval works.

Waiving or shortening cooling-off

A seller may ask you to waive or shorten the cooling-off period, which is done with a certificate from your solicitor or conveyancer. Doing so removes your right to withdraw during that time.

It can make an offer more attractive, but only makes sense if your finance and checks are already complete. Your solicitor or conveyancer can explain what you are giving up. First home buyer checklist.

What if the valuation is lower?

If the lender’s valuation comes in below the price, the lender lends against the lower figure, and you need a larger deposit or a higher LVR to make up the difference.

Finding this out within the cooling-off period gives you options that disappear once it ends. Low bank valuations.

Private sale, auction or off-market?

Three ways homes sell, and what each means for your finance.

  • Private treaty. Usually a five business day cooling-off period. Time to finalise finance, if it is already underway.
  • Auction. No cooling-off period. Finance must be ready before you bid.
  • Off-market. Often private treaty terms, negotiated directly. The same cooling-off rules generally apply.

The groundwork that makes the cooling-off period enough.

Common questions about buying in Berala by private sale

What is the cooling-off period in NSW?

For most residential property sold by private treaty, it is five business days after exchange. You can withdraw during that time, usually forfeiting a quarter of one per cent of the price.

Is there a cooling-off period at auction?

No. Property bought at auction, or on the day of a failed auction, generally has no cooling-off period, so finance needs to be ready before you bid.

Is pre-approval enough to exchange?

Not on its own: pre-approval is conditional, and the lender still has to value the property and confirm your details, which is why having it underway before exchange helps you finish within the cooling-off period.

Can I get a finance clause in a NSW contract?

Not as standard: the NSW contract has no finance clause, but your conveyancer can negotiate a special condition, which the seller may or may not accept.

Should I waive the cooling-off period?

Only if your finance and checks are complete and you understand what you are giving up. Your solicitor or conveyancer can advise on the certificate and its effect.

What happens if the valuation comes in low during cooling-off?

You can negotiate the price, add to your deposit, accept a higher LVR, or withdraw and forfeit the small cooling-off amount.
