Temporary residents buying in Wolli Creek

Temporary residents are foreign persons under Australia’s foreign investment rules. From 1 April 2025 to 30 June 2029, foreign persons are banned from buying established dwellings, with limited exceptions, so a temporary resident can generally buy only a new dwelling, such as an apartment in a newly completed or off-the-plan building, or vacant land to build on. Approval is needed first unless a developer’s exemption certificate covers the purchase.

On top of that, NSW charges foreign persons surcharge purchaser duty in addition to standard transfer duty, and lenders that lend to visa holders usually want a larger deposit and a minimum time left on the visa.

Buying jointly with a spouse who is a citizen or permanent resident can change some of this, under conditions worth checking with a solicitor. Home loans for temporary residents in detail

Tempe House, the river and the station

Wolli Creek lies about ten kilometres south of the city by its official measure, in Bayside Council, between Arncliffe and Tempe beside the Wolli Creek and Cooks River waterways. The traditional owners of the land around the Wolli Creek valley are the Bidjigal people.

The suburb was part of Arncliffe and mostly industrial until the late 1990s. It was to be called North Arncliffe, but residents asked for a vote and chose Wolli Creek, the station opened in 2000, and the suburb was declared in 2002.

High-density apartment buildings went up through the 2010s, with the Village Square shops opposite the station entrance. Almost all homes are apartments, and between the last two Censuses the population grew by about two thirds.

When a Wolli Creek buyer holds a temporary visa, Links compares a panel that includes Macquarie, ING, Resimac, ANZ and Westpac, though only some lenders accept particular visas.

Example scenario (illustrative, not a real client): two software engineers on temporary skilled visas have rented in Wolli Creek for three years and want to buy a two-bedroom apartment in a building nearing completion.

Before signing, they confirm in writing that the developer’s exemption certificate covers the apartment, budget for surcharge purchaser duty on top of transfer duty, and choose a lender that accepts their visas and the time left on them.

New, off the plan or established?

A temporary resident can generally buy a new apartment, including one off the plan, with approval, but not an established one until the ban ends on 30 June 2029.

Whether an apartment counts as new is decided by the foreign investment rules, not by how new it looks.

Off-the-plan purchases add a long gap between contract and settlement, and the valuation at settlement can differ from the price. Off-the-plan home loans.

The costs on top of the price

Foreign persons usually pay an application fee for approval and, in NSW, surcharge purchaser duty on top of transfer duty. A land tax surcharge can also apply each year.

Building these into your budget first stops a good apartment becoming an unaffordable one. Buying cost calculator.

Once you are a permanent resident

Once you hold a permanent visa and live here, you are generally no longer a foreign person, the surcharge falls away for future purchases and the 5% Deposit Scheme can open up.

If permanent residency is close, waiting can change both what you can buy and what it costs. Home loans for permanent residents.

Which apartments are open to you?

What new, off the plan and established mean for a buyer on a temporary visa.

  • New apartment. Generally open with approval. Ask about the developer’s exemption certificate.
  • Off the plan. Open with approval, settling later. The valuation happens near completion.
  • Established. Banned for foreign persons until 30 June 2029. Limited exceptions only.

Common questions about buying in Wolli Creek on a visa

Can I buy an apartment in Wolli Creek on a temporary visa?

Generally only a new one, with approval, until 30 June 2029. Foreign persons, including temporary residents, are banned from buying established dwellings until then, with limited exceptions.

How do I know if an apartment counts as new?

The foreign investment rules decide, not the age of the building. A developer may hold an exemption certificate covering sales in a project, which you can ask about before signing.

Do I need approval if the developer has an exemption certificate?

Not for a dwelling the certificate covers. The certificate belongs to the developer, so ask for written confirmation that it applies to the apartment you are buying.

How much deposit do temporary residents need?

Usually more than citizens. Lenders that lend to visa holders often cap the loan at a lower share of the value, and mortgage insurance may not be available.

Will I pay extra stamp duty?

Usually, yes. Foreign persons pay NSW surcharge purchaser duty on top of transfer duty unless an exemption applies, such as for some partner visa holders who meet the residence requirement.

Can I buy with my partner who is a citizen?

Yes. Buying as joint tenants with a citizen spouse can be exempt from foreign investment approval, though duty and lender rules still need checking. A solicitor can confirm the position.
